TERMS & CONDITIONS
ARTICLE 1 – APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE
The following General Terms and Conditions of Sale apply exclusively to the sale of our products on the website www.leagivetceramique.fr.
Purchasing our products implies full and unconditional acceptance of these Terms and Conditions by the buyer.
The information recorded on the website www.leagivetceramique.fr constitutes proof of all transactions between Léa Givet and the buyer, unless proven otherwise.
By accepting these Terms and Conditions, the buyer agrees not to make purchases for resale, within the meaning of Article L 110-1 of the French Commercial Code.
These Terms and Conditions are the exclusive property of the seller. Any reproduction, even partial, is strictly prohibited.
ARTICLE 2 – PRODUCT AVAILABILITY
Products and their prices are valid as long as they are displayed on the website, and subject to availability.
In the event that one or more products are unavailable after an order has been placed (except in cases of force majeure – see relevant article), the buyer will be notified as soon as possible and may cancel the order.
In such case, a refund will be issued to the buyer's bank account within 30 days from the date of payment.
ARTICLE 3 – TRANSFER OF OWNERSHIP AND PRICING
Prices shown on the website are in euros and include all production-related costs, excluding shipping fees.
Displayed prices are inclusive of VAT.
ARTICLE 4 – DELIVERY
Products are delivered to the address provided by the buyer when placing the order.
It is the buyer’s responsibility to provide all necessary delivery details, such as: exact address, door code, floor number, etc.
Léa Givet cannot be held responsible for failed deliveries due to missing or incorrect information.
If delivery fails, the order will be returned to Léa Givet’s address.
The buyer must then contact Léa Givet at leagivetceramique@gmail.com to arrange collection of the purchased products.
In such cases, Léa Givet does not guarantee a timeframe for product collection.
4.1 – SHIPPING COSTS
Shipping costs on our online store are calculated based on the volume and weight of each item according to current postal and carrier rates.
4.2 – DELIVERY TIMES
Unless otherwise stated on the site, Léa Givet will make every effort to dispatch ordered items within an average of 7 days following order confirmation.
If one or more items are unavailable (and this is not specified on the product page), the customer will be informed via email or phone and the unavailable items will be refunded via the original payment method.
If the workshop is closed, a notice will be posted on the website indicating the reopening date, and deliveries will resume thereafter.
ARTICLE 5 – PAYMENT
Online payments are made by credit card.
The secure payment platform used for our online store is Stripe.
Stripe complies with credit card regulations concerning remote and online payments, as well as with the standards of accepted card networks (CB, MasterCard, Visa, Amex).
ARTICLE 6 – RIGHT OF WITHDRAWAL
In accordance with Articles L.121-21 et seq. of the French Consumer Code, the buyer has a 14-business-day period from the date of delivery to exercise their right of withdrawal.
The buyer must notify Léa Givet of their decision by email before returning the goods to: leagivetceramique@gmail.com.
Return shipping costs are the responsibility of the buyer.
Products may be returned using the buyer’s chosen method.
The value of the returned products will be refunded within 1 to 3 weeks, excluding initial shipping fees.
Refunds are only possible if the products are returned in their original condition.
Used, incomplete, or damaged items will not be refunded.
Only the individual who placed the order may exercise the right of withdrawal.
If delivery was made to another person, that person cannot exercise this right.
ARTICLE 7 – REFUND POLICY
Refunds will be processed within 14 calendar days of receipt of the returned items.
Reimbursements will be made to the buyer’s bank account.
ARTICLE 8 – SECURITY
Léa Givet uses the Stripe platform to protect all sensitive and critical payment-related data.
ARTICLE 9 – CUSTOMER SERVICE
For any inquiries, Léa Givet responds to messages from Monday to Friday, 9 a.m. to 4 p.m. at the following address: leagivetceramique@gmail.com.
ARTICLE 10 – INTELLECTUAL PROPERTY
All trademarks, domain names, products, software, images, videos, texts, and more generally any element subject to intellectual property rights remain the exclusive property of Léa Givet.
No transfer of intellectual property rights is made through these Terms and Conditions.
Any total or partial reproduction, modification, or use of these materials for any reason is strictly prohibited.
ARTICLE 11 – LIABILITY
The buyer is free to refer to the product description available on the website to understand its characteristics.
If in doubt or if further information is required, the buyer may contact Léa Givet at: leagivetceramique@gmail.com.
ARTICLE 12 – FORCE MAJEURE
Any unforeseeable, unavoidable, and external event beyond the control of the parties, as defined under Article 1148 of the French Civil Code and case law, will be considered a case of force majeure.
In such cases, neither Léa Givet nor the buyer shall be held liable for failure to fulfill contractual obligations.
ARTICLE 13 – APPLICABLE LAW – DISPUTES
These Terms and Conditions are governed by French law.
In the event of a dispute or claim, the buyer shall first contact Léa Givet to seek an amicable solution.
If no agreement is reached, the buyer may file a claim with the territorially competent French district court.
